The Naperville Park District (“Park District”) is committed to providing safe aquatic facilities and programs and holds the safety of participants in high regard. The Park District continually strives to reduce such risks and insists that all participants follow safety rules and instructions that are designed to protect the participants’ safety. However, participants and parents/guardians of minors engaged in aquatic activities must recognize that there is an inherent risk of injury.
You are solely responsible for determining if you or your minor child/ward are physically fit and/or adequately skilled for the activities associated with this Reservation for Centennial Beach (“group reservation”). It is always advisable, especially if the participant is pregnant, disabled in any way or recently suffered an illness, injury or impairment, to consult a physician before undertaking any physical/aquatic activity.
Please understand and recognize that adult patrons and parents/guardians of minor patrons are primarily responsible for assessing their respective swimming skills. Further, parents/guardians of minor patrons must understand that it is the parent/guardian’s sole responsibility to provide adequate and qualified supervision for any and all activities contemplated by this agreement and Beach Group Reservation. Adult patrons and parents/guardians of minor patrons must further understand and recognize that lifeguards are not responsible for providing supervision; rather, lifeguards are responsible for enforcing safety rules and responding to emergencies.
Children 11 years of age and under must be supervised at all times by a responsible person, 16 years of age or older. Further, any non-swimmer of any age must be accompanied and within arms’ distance of a qualified adult supervisor at all times such persons are in the water.
Photo/Video Policy and Warning: Photos and video footage are periodically taken of people participating in a Park District program or activity, attending a class or event, or using District facilities or property. Please be aware that by registering for a program or class, participating in an activity, attending an event, or using District facilities or property, you authorize the District to use these photos and video footage for promotional purposes in District publications, advertising, marketing materials, brochures, event flyers, social media (including Facebook, YouTube, Instagram, Twitter, and other social media sites operated by the District), and the District’s website without additional prior notice or permission and without any compensation to you. All photos and videos are property of the District.
Participant Behavior Code of Conduct: All people participating in a Park District program or activity, attending a class or event, or using District facilities or property are expected to exhibit appropriate behavior at all times and adhere to the Naperville Park District Behavior Code of Conduct. A copy of the Behavior Code of Conduct can be found at www.napervilleparks.org. The failure to follow the Naperville Park District Behavior Code of Conduct, or program or facility rules, may result in the removal of the participant from the program, event or facility.
NEVER LEAVE ANY CHILD OR ADULT PATRON WITH POOR OR LIMITED SWIMMING SKILLS UNACCOMPANIED BY A QUALIFIED ADULT SUPERVISOR OR COMPANION.
Warning of Risk
Swimming and other aquatic activities challenge and engage the physical, mental and emotional resources of each participant. However, despite careful and proper preparation, instruction, medical advice, conditioning and equipment, there is still a risk of serious injury, including but not limited to drowning, head/brain injury, and spinal cord injury. Understandably, not all hazards and dangers can be foreseen. The very nature of swimming and aquatic activities are hazardous and risky, including but not limited to fatigue and overexertion, poor swimming skills, failing to avoid dangerous areas, failing to follow rules and regulations, failure of lifeguards to locate victims and/or delay in emergency response time, horseplay, diving or cannon-balling into shallow water and striking the bottom or side of the Beach or waterslide, inadequate supervision or instruction, lack of conditioning, becoming disoriented, striking other swimmers, striking one’s head on the bottom or sides, slip and falls on the deck or within the Centennial Beach facility, chemical exposure, exposure to communicable disease arising out of a group activity in general, and all other circumstances inherent to aquatic activities. In this regard, it must be recognized that it is impossible for the Park District to guarantee absolute safety.
WAIVER AND RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK
Please read this language and form carefully and be aware that in consideration for Centennial Beach Group Reservation privileges, you will be expressly assuming the risk and legal liability and waiving and releasing all claims for injuries, damages or loss which you or your minor child/ward might sustain as a result of participating in any and all activities connected with and associated with the privileges and rights granted by this agreement. Specifically, you recognize and acknowledge that there are certain risks of physical injury to Centennial Beach facility users and Beach group reservation participants, and you voluntarily agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that your minor child/ward or you may sustain as a result of said participation. You further agree to waive and relinquish all claims you or your minor child/ward may have (or accrue to your or your child/ward) as a result of participating in any and all Centennial Beach activities against the Naperville Park District, including its officials, agents, volunteers and employees.
By your use of Centennial Beach, you agree that you have been provided with and have read the above Warning of Risk and Important Information section and recognize and agree that lifeguards and other aquatic staff are not responsible for supervising your activities or the activities of your minor child(ren) and you agree that you are solely responsible for supervising your minor children/wards and/or assessing whether your children/wards are physically fit and/or adequately skilled for aquatic activities. You additionally agree to supervise any children ages 11 and under at all times.
You release and forever discharge the Naperville Park District from any and all claims for injuries, damages or loss that your minor child/ward or you may have or which may accrue to you or your minor child/ward arising out of, connected with, or in any way associated with use of the Park District’s aquatic facilities and programs.
By accepting the Beach Group Reservation, you agree that you have read and fully understand the above important information, warning of risk, assumption of risk and waiver and release of all claims.
