Seller herein certifies that the property Seller is offering for sale through the broker was built in the year specified in this document, and Seller has been informed by the broker of the lead-based paint disclosure requirements under The Residential Lead-Based Paint Hazard Reduction Act of 1992, 42 U.S.C. §4851-4856 (the “Act)”. Seller agrees to sign all the necessary disclosure forms, of which copies are attached hereto and made a part hereof by reference in order to abide by this Act; and, to disclose in writing to the broker and to prospective purchasers any other physical characteristics of the property that may adversely affect its value. Seller understands and agrees that all the information above will be provided to agents who may represent other parties. Seller hereby waives any claims arising out of disclosure of such informationto other parties. Seller agrees above information is true and correct to the best of his/her knowledge.
Greentree Realty, Inc. is a licensed real estate brokerage in the state of Georgia. It is a flat-fee, limited service company. It does not provide the same services as a "traditional" brokerage. Likewise, you are paying a reduced flat fee rather than the more common percentage fee typically charged by full-service brokerages. The undersigned has ordered a real estate brokerage service package from Greentree Realty, Inc. to list their property in the GA MLS system. GA License #H-50891; Agent License # 294554.
Using the services of Greentree Realty does not create any agency relationship between you and Greentree Realty. Greentree Realty does not actually represent you and is acting as a Transaction Broker. The Official Code of Georgia Section 10-6A-3 (14) defines "Transaction broker" as a Broker who has not entered into a client relationship with any of the parties to a particular real estate transaction and who performs only ministerial acts on behalf of one or more of the parties, but who is paid valuable consideration by one or more parties to the transaction pursuant to a verbal or written agreement for performing brokerage services. The Official Code of Georgia Section defines "ministerial acts" as those acts related to real estate brokerage activities which a licensee or a licensee's employee performs and which do not require discretion or the exercise of the broker's or the broker's affiliated licensee's professional judgment or skill.
Greentree Realty will provide such ministerial acts as stated in the service list of the particular product you purchase. Such acts may include submitting the information you provide to the multiple listing service directory, providing you with pre-printed forms, etc. None of the ministerial acts performed by Greentree Realty shall be constructed in such a manner as to form a brokerage engagement with you.
Greentree Realty does not provide assistance in any manner that would require it or its principles to exercise discretion or judgment. Examples of services that are not provided include suggesting a sales price and negotiating contracts.
Greentree Realty works to maintain its web site and services, but is not responsible for defects that may exist within its web site or any resulting loss of profits or other damages. Greentree Realty attempts to accurately enter the information you provide into the multiple listing service. However, Greentree Realty does not guarantee error-free service. If you discover any error you must promptly notify Clickit so the error can be remedied. Greentree Realty is not responsible for any loss or damage suffered by the error.
Greentree Realty shall under no circumstances have any liability greater than the amount it received from you for its services. You agree to hold Greentree Realty harmless from any and all claims, causes of action, or damages arising out of or relating to your providing incomplete and/or inaccurate information to Greentree Realty and in connection with any loss that may occur.
The Seller is responsible for complying with any subdivision, city, county, and state requirements in regards to signage laws, ordinances or restrictions. Should you be guilty of violating any laws, restrictions or ordinances, any resulting citations, fines or levees will be your responsibility and will be charged to your credit card on file.
Seller agrees to submit an executed contract to Greentree Realty within 48 hours after both parties have signed, and a settlement statement within 24 hours after closing so all Multiple Listing Services can be updated to eliminate MLS fines being charged back to the Seller.
Should you withdraw your listing prior to the expiration date, you will be charged a fee of $25 per Multiple Listing Service you are listed.
During the course of the listing, if a yard sign needs replaced due to damage or theft, the Seller agrees to pay a $50 sign fee which includes shipping and handling. Seller hereby releases Greentree Realty and those working through Greentree Realty from all liability and responsibility in connection with any loss that may occur.
